The process of checking documents related to a property. When a bank provides a loan, a tenant leases space or an investor signs a purchase agreement with the owner of a property, each transaction is based upon assumptions regarding the legal and technical status of the property and the owner’s rights to it. The process of Due Diligence reviews original legal and technical documents or certified copies there of to validate, or underwrite, the claims of the owner. Generally the review includes the history of the property, including its ownership and permissions to confirm that the property and its ownership are in compliance with the law. Technical Due Diligence includes the physical inspection of the property, often with testing of systems.
